The ninth circuit court of appeals ruled on Tuesday that it would reexamine the legal dispute concerning the executive power with an larger panel of 11 judges. The judicial body also overturned a earlier ruling from a three-judge panel that had sided with the administration.

Legal Saga Over Military Presence

This order represents the latest development in a protracted legal battle over whether the former president has the authority and justification to send national guard forces in the city. Approximately 200 federalized guard members have been in limbo since late September when the deployment effort was started in response to ongoing demonstrations.

The administration has argued that government employees at the immigration center in south Portland were under attack, while city and state officials maintain that municipal police have command of the situation.

Recent Legal Actions

The Tuesday ruling came after a US district judge in Portland issued two legal injunctions this period – one blocking the federalization of the Oregon national guard, and another prohibiting the deployment of any military personnel in the state, after attempts to circumvent the initial injunction by calling up troops from California.

On Monday, the ninth circuit panel had put the first ruling on hold – allowing control of 200 Oregon national guard – but the second ruling remained in place, preventing the actual deployment of the troops.
